Prosecutor's Office of the Supreme CourtJudiciary

Spain

What it is

The Prosecutor's Office of the Supreme Court (Fiscalía del Tribunal Supremo) is the apex body of the Spanish public prosecution service (Ministerio Fiscal), operating directly before Spain's highest court. Headed by the State Attorney General, it is mandated to defend the rule of law, safeguard citizens' rights and the public interest, and handle appeals in cassation across civil, criminal, administrative, social, and military jurisdictions. While formal state prosecutor roles before high courts date back to 19th-century judicial statutes such as the Organic Law of the Judiciary of 1870, the institution's contemporary democratic structure was definitively established under Article 124 of the 1978 Spanish Constitution.
